William McFadden Estate Packet: 1873

Biographical Notes
 William McFadden was born June 9, 1790 in Virginia (according to 1850 census) and died 17 February 1872 in Itawamba County. He married Catharine B. Holloway in Putnam County, Georgia on May 12, 1814 and later settled in Marion County, Alabama. During 1838 he received federal land patents on 11 quarter sections of land at the Pontotoc Federal Land office from Chickasaw lands. He brought his family to Itawamba County around 1839 from Alabama and settled on the large tract of land he had purchased from the government consisting of about 1,700 acres in the present-day Tilden community.

Application for Administration

To the Honorable O.H. Whitfield, chancellor of the 6th Chancery Distr5ict of said state presiding in and for the county of Itawamba at the court house in the Town of Fulton:

The petition of B.B. McFadden and V.B. McFadden, the former a citizen of the county of Itawamba and the latter of the County of Lee in said state, bortyh of whom are above the age of 21 years, would respectfully state and show unto your honor that they are both the sons, the former, being the oldest son of William McFadden late of said county of Itawamba deceased. That their dec'd father departed this life on or about the 17th day of February 1872 at his permanent residence in said county leaving no will so far as your petitioners know or believe. That said intestate died siezed and possed of a small real and personal estate conssisting of several quarter sections of land in said county, a small stock of cattle and hogs, corn, household and kitchen furniture, one buggy, farming tools and one set of blacksmith tools, and a small amount due him supposed to be about one hundred dollars, and some cash on hand, supposed to be about the sum of seven hundred twenty nine dollars in currency and also about the sum of eleven hundred and forty eight dollars in gold all of said personal estate being estimated to be worth not exceeding three thousand dollars. That the said intestate left surviving him his widow Sarah McFadden, his second wife who resides in said county of Itawamba, who has relinquished her right to administration in favor of your petitioners ... that the said decedent and his said widow before their marriage entered into a marriage contract which was duly acknowledged and recorded by which they agreed each to retaint heir separate estate both real and personal and the oncome thereof and in the event of the death of the said intestate, first his said widow to receive a child's part of the estate in lieu of dower ... that in addition to his said widow and your petitioners, the said intestate left surviving him as heirs and distributees Elmina Thomas, wife of E.G. Thomas of Lee County, Mississippi, Mary Jane Hankins, wife of E.L. Hankins also of Lee County, Sarah Ann Gideon, wife of Lewis H. Gideon of the State of Texas, Martha Medley, wife of George Medley also of the state of Texas, Oliver P. McFadden of the State of California all of whom are children of said decedant and the following minor children of Willis M. McFadden, deceased, who was also a son of said decedent towit: Goodlow McFadden, Virginia McFadden, Elmina McFadden, Mary McFadden ...

The petition of B.B. and V.B. McFadden, administrators of the estate of Wm. McFadden, dec'd. would respectfully state and show unto your honor that they have fully administered said estate as shown by the within final account which they ask may be allowed and that citations be issued to the following heirs or distributees within jurisdiction of your honorable court towit: Sarah McFadden, widow, who lives in Lee County, Mary J. Hankins and her husband E.L. Hankins of Lee County, John D. Thomas, Bettee Momus, Kate Finley her husband James L. Finley, Mattie Kyle and her husband James R. Kyle of Lee County, Robert G. McFadden, Virginia McFadden, Elmira McFadden and Mary McFadden, minor heirs of Willis McFadden, dec'd who's guardian is one of your petitioners of Itawamba County, O.P. McFadden, who resides in the state of California who's post office is Carulbia, San Luis Obispo County, Martha C. Medley and her husband G.W.
