John K. Estes Probate  Packet: 1862

Biographical Notes

John Kennedy Estes was born on March 30, 1830 in Chester County, South Carolina. He was the son of William Ellis Estes (born 27 June 1805) and Nancy Kennedy (born 14 November 1799). John Kennedy Estes lived in the southwestern part of Itawamba County. On April 25, 1860 he married Margaret Samantha Boston (born 23 June 1842 in North Carolina), daughter of  John Boston and Sarah Louanna Repult. During the Civil War, John Kennedy Estes died in service on August 9,1862 in Georgia. John Kennedy and Margaret S. Boston Estes were the parents of two children: John Kennedy Estes, Jr. (born 23 May 1861) and Sarah Louanna Estes (born 22 February 1863).

We, the undersigned appraisers being appointed and sworn according to law to appraise the goods, chattels and personal estate of John K. Estes deceased, do hereby certify that we have set apart to Margaret S. Estes, wife of said John K. Estes deceased, as follows to wit: fifteen head of stock hogs, 2 cows and calves and 2 heifers, one horse, wearing apparel of decedent, household and kitchen furniture not exceeding two hundred and fifty dollars in value. Given under our hands and seals this 21st November 1862

The petition of the undersigned represents to your honor that some time in August last John K. Estes departed this life leaving no last will and testament as your petitioner believes, that said decedent left a small personal estate consisting of notes and accounts, one buggy, one horse, household and kitchen furniture, one watch, one shot gun and one pistol amounting according to estimates One Thousand collars. ... further that the widow has removed her right to Letters of Administration wherefore your petitioner prays you now grant him Letters of Administration...R.A. Estes and W.E. Estes Junior as security ...

The petition of W.E. Estes, Sr., administrator of the estate of John K. Estes, deceased, would respectfully represent and show unto your honor that the sum of forty one dollars in Confederate money come into his hands as admr. aforesaid belonging to the estate at the time of his appointment as such. And that he loaned the same out at the rate of eight percent per annum and that the same was paid to him in Confederate money on or about the first day of April AD 1865. You petitioner would further show that he was unable to use the same it being loaned out and beyond his immediate control and that he was unable to use the same after the same was collected and that the same become worthless on his hands. Your petitioner would therefore pray your honor for an allowance for the same.

The undersigned widow of John K. Estes dec'd being in great need of a cow and calf, for the benefit of myself and children, being the heirs of my deceased husband have this day received of Wm. E. Estes, administrator of the estate of my husband John K. Estes, dec'd. twenty five dollars for which said money has been paid for said cow and calf which is now in my possession which amount I am willing to allow out of my share of said estate on final settlement of the same.

The petition of M.S. Estes, widow of John K. Estes, late of said county, deceaesd, and guardian for John K. Estes Jr., and Sarah L. Estes, minor heirs of John K. Estes, deceased, would respectfully represent and show unto your honor that at the September Term 1862 of this honorable court. Wm. E. Estes Sr., was appointed administrator of the goods and chattels, rights and credits which were of John K. Estes deceased, and that he proceeded to administer said estate. Petitioner is informed and believes that all the debts against said estate has been paid off and discharged by said administrator and that all the debts due said estate as been collected by said administyrator, and that said estate has bully been administered ... petitioner prays your honor for a citation to said Wm. Estes, to be and appear at the next term of this honorable court to show cause if any he can why he hsould not make a final settlement of said estate...
